You accept this Statement when you create your account, together with the Terms of Use, and it covers everything you publish on Gigbusters that other people can see —a band or venue profile, a concert, a song or video, a record, a listing, a gig offer—. It is what you affirm every time you publish, without having to tick anything again. It forms part of the Terms of Use (in particular sections 5, 9 and 10) and the Community Guidelines, which continue to apply to everything not covered here. It is written to be understood; if anything is unclear, ask us at legal@gigbusters.com before publishing.
Everything you upload, write or link on Gigbusters that is shown to third parties, within the service or on the pages and cards the service generates when a link is shared. Specifically:
What you write in a private negotiation with another party is also yours and you are also responsible for it (Terms, section 5), even though it is not shown to third parties.
By accepting this Statement, and every time you publish, you declare, under your own responsibility, that:
You are directly responsible for the content you publish, towards third parties and towards us. If a third party makes a claim over something you have published, you will answer for it under section 12 of the Terms of Use.
Gigbusters is a service provided by Era Creativa Agencia Digital S.L.U. that hosts and displays content provided by its users. We are an intermediary service provider —a hosting service within the meaning of Article 16 of Spanish Law 34/2002 on information society services and electronic commerce (LSSI-CE) and Article 6 of Regulation (EU) 2022/2065, the Digital Services Act—. This means that:
The licence you grant us to display your content is the one in section 5 of the Terms: non-exclusive, free, worldwide and revocable, limited to making the tool work and promoting the service itself. We do not sell your content or hand it over to anyone to exploit it.
When we become aware that content is illegal, infringes third-party rights or is contrary to the Terms or the Community Guidelines —or when a competent authority requires it— we reserve the right to, at any time and without prior notice where the situation justifies it:
Measures are gradual and proportionate. Whenever we take one we will tell you what we did, why and on what basis, and how to appeal, unless a legal rule forbids us; the full procedure, including how to appeal if you think we got it wrong, is in the Community Guidelines (sections 7 and 8) and in the Terms (section 10). Suspending an account does not cancel agreements you have already closed with other people: we withdraw your access, we do not release you from your word.
We may keep a copy of removed content and the data proving who published it, when and what they declared, for as long as needed to handle complaints, meet legal obligations and cooperate with the authorities, in accordance with the Privacy Policy.
Anyone can report content they consider illegal or contrary to these rules, whether or not they have an account. If you have one, the report button is on the profile of the band, venue, event or listing itself. If not, write to moderacion@gigbusters.com.
So we can act quickly, tell us:
We acknowledge receipt, review the notice without undue delay and diligently, and, if you left us an email, we tell you our decision. Malicious or manifestly unfounded and repeated notices are a misuse of the tool and we will stop processing them. Whoever published the reported content may appeal our decision through section 8 of the Community Guidelines.
Part of the agenda is not published by a user: we collect it from open data portals and other public sources that allow their information to be reused, and in those cases we credit the source on the event page. This Statement does not apply to that content; its rules are in section 5 of the Terms. If you are the owner of such an event and want it corrected or removed, write to us.
Acceptance happens when you create your account, in the same box with which you accept the Terms of Use, and it covers everything you publish while that version is in force. We store in your account which version you accepted and when, and we also record it with each piece of content you publish, so we can prove it if needed. If we change this Statement or the Terms we will publish a new version with its date and ask you to accept it the next time you log in; until you do, you will not be able to publish. What was already published keeps the version accepted at the time. Anything published before 14 September 2026 is governed by section 5 of the Terms of Use, which already contained these same warranties.
This Statement is governed by Spanish law. Complaints and jurisdiction are governed by section 15 of the Terms of Use. The service owner's details are in the Legal Notice.
